DUI – Drivers License Suspended in Illinois?
Reader’s Question:
My driver’s license got suspended and it is nearing the end of the suspension period. How do I get my license back so that I can drive again especially to and from work here in Aurora, Illinois?
Cannon
Aurora, IL
To have your driver’s license reinstated so that you can drive again especially to and from work in Aurora, Illinois, it would depend on what the violation was and the state laws or regulations of the state where your license got suspended or revoked. If the reason why your driver’s license was suspended was due to unpaid tickets then it could be as simple as paying the fines and fees for these violations and complete the requirements to have your driving privileges back.
If your driver’s license got suspended due to a DUI offense, the state of Illinois might require you to complete DUI school, pay fines and get an SR22 auto insurance. If your driver’s license was suspended due to a lot of points, check if a driving improvement class could let you have your driving privileges back. You can also contact the Department of Motor Vehicles to get particular information on reinstating your driver’s license.

Illinois Auto Insurance Canceled After DUI Charge?
Reader’s Question:
Is it true that my mom’s car insurance can be canceled because of her DUI charge here in Des Plaines, Illinois?
Val
Des Plaines, IL
Most of the state laws regarding insurance specifically spell out the circumstances under which a car insurance company can cancel a policy. There are certain grounds for cancellation of car insurance and the most common are:
-you or a member of the household loses driving privileges during the policy period because of license expiration, suspension or revocation
-you fail to pay the premium on time
-you misrepresent material facts about your risk – which means your driving history, claims history or the number of people who have access to your vehicle.
In your mom’s DUI case if her driver’s license is suspended or revoked, this can be a ground for the cancellation of her car insurance. This can be very inconvenient for her so if her car insurance gets canceled, she needs to get another car insurance provider right away. Luckily, she can definitely get great car insurance it will just be a little harder to find, and the rates will obviously be a little higher, but don’t give up hope. Clean up her act, and the rates will eventually go back down over time.
Illinois DUI Record Expungement
Reader’s Question:
My brother has a DUI conviction in Illinois and I have been doing several researches about the DUI state laws. I came across some information about clearing a DUI record. Is it true that he can have this DUI conviction completely erased?
Nadine
Schaumburg, IL
Your brother’s DUI conviction in Illinois does not have to haunt him for a lifetime. In fact, he can expunge his criminal records, remove all his record of a past arrest and he can move on with his life and put those past transgressions behind him.
Your brother can obtain an expungement after he has completed supervision, and waited for the obligatory statutory period of time to expire. When this occurs, his DUI lawyer can file a petition with the State’s Attorney, the clerk’s office, the local arresting agency, and the State Police stating that he intends to expunge his arrest records. The police will have the opportunity to present any objections they may have to the court, and the court can either deny or grant the petition. In the event the court denies his petition, he can appeal to a higher court. One more thing is that the only way to get a conviction off of his record is to petition for executive clemency. His DUI lawyer should have experience in executive clemency and will petition the Governor’s office through the Illinois Prison Review Board. Clemency does not erase the crime, though, rather it simply forgives it, so that the conviction may no longer be used against him.
Illinois DUI Lawyers – What To Look For?
Never go to see your IL DUI lawyer unprepared. There are a few things you should do first. Maybe not absolutely necessary, but definitely advisable.
- Visit the library.
Head over to your local library branch and check out resources for your state DUI laws. You can assess the knowledge of your IL DUI lawyer better if you have a vague idea of what they should know. I’m not saying memorize all of the DUI laws there are, but just skimming some information and taking a few lines of notes could go a long way.
- Know what’s against you.
Your IL DUI lawyer will need to know for your case what kind of evidence there is against you. When you were pulled over, did you give off physical signs of drunkenness such as slurred speech, bloodshot eyes, and all of that? Did behaviour such as erratic driving draw the police’s attention to you to begin with? Did you say anything incriminating? Were you tested for blood alcohol concentration, and if so, what were the results?
